This privacy policy (hereinafter the "Policy") describes how Vacances Bleues (also referred to by "we", "us", "our") processes the personal data of Vacances Bleues' customers and prospective customers (all such persons being hereinafter collectively known as the “Data Subject(s)”, and referred to by “you”, “your”).

Respecting your privacy and personal data is extremely important for Vacances Bleues. We therefore undertake to process your data in compliance with the French Data Protection Act no. 78-17 of 6 January 1978 as amended, the General Data Protection Regulation (EU) 2016/679 of 27 April 2016 (hereinafter "GDPR") and the related CNIL standards and recommendations (together the "Applicable Regulations").

 

I. IDENTITY OF THE DATA CONTROLLER

Vacances Bleues acts as data controller for all data collected for the purposes of its business activities.

 

2. GATHERING PERSONAL DATA

In the course of its business activities, Vacances Bleues may collect and process personal data from the Data Subject, in particular when the Data Subject:

  • Browses the main "vacancesbleues.fr’" website and any other "satellite" site specific to each establishment (hereinafter the "Site") and uses its functions and features;
  • Opens a user account;
  • Signs up for the Vacances Bleues newsletter;
  • Expresses an interest in the services offered by Vacances Bleues (e.g. requests a catalogue or a quotation);
  • Contacts Vacances Bleues with a request for information about the services it offers;
  • Makes a booking with Vacances Bleues;
  • Takes part in activities on the Vacances Bleues sites;
  • Exercises their rights as set provided for in the Applicable Regulations.

These data include:

  • data used to establish your identity (surname, first name(s), postal address, e-mail address, telephone number(s), date of birth, gender, number of children, membership number for any partner organisation, ID card or passport number), as well as data you provide about the individuals for whom you are booking a service. You undertake to obtain their prior consent to communicate their relevant personal data;
  • connection and browsing data (by means of cookies) as described in our cookie policy below;
  • payment details required to place an order for service(s),
  • data required to run competitions and games,
  • booking and contact history with us (customer number, requests for documentation, history of products and services ordered and paid for).
  • your preferences (hobbies, interests, etc.)

 

3. PURPOSES OF DATA PROCESSING AND LEGAL BASIS

We use your personal data for the following purposes:

  • To manage your stay (the legal basis for this processing is the performance of our contractual relationship or our legitimate interest in data that exceeds what is necessary for the performance of our contractual relationship);
  • To manage your booking data (the legal basis for this processing is the performance of our contractual relationship)
  • To control access to customer accounts (the legal basis for this processing is our legitimate interest);
  • To check and authenticate your data (the legal basis for this processing is our legitimate interest);
  • To combat fraud, misuse, viruses and other malicious software (the legal basis for this processing is our legitimate interest);
  • To manage customer contracts (the legal basis for this processing is the performance of our contractual relationship);
  • To send you commercial messages and advertisements based on your browsing history, preferences and interests (the legal basis for this processing is our legitimate interest or your consent if required by law);
  • To manage games and competitions (the legal basis for this processing is the performance of our contractual relationship);
  • To manage the loyalty scheme (the legal basis for this processing is the performance of our contractual relationship);
  • To manage customer opinion and satisfaction surveys (the legal basis for this processing is our legitimate interest);
  • To manage contact requests (the legal basis for this processing is our legitimate interest)
  • To manage your participation in solidarity projects sponsored by the Vacances Bleues Foundation (the legal basis for this processing is the performance of our contractual relations);
  • To monitor calls made to the reservations centre (the legal basis for this processing is our legitimate interest).
  • To manage payment incidents and complaints (the legal basis for this processing is our legitimate interest);
  • More generally, we use, store and process your Data in order to process your requests, manage our commercial relationship, optimise our services and tools to create and maintain a more secure environment of trust, and to comply with our legal obligations.

 

4. DATA RETENTION PERIOD

As a general rule, your Data are held only for as long as is necessary to complete the operations for which it is collected (without prejudice to the legal possibilities of storage and the obligations to retain certain data, in particular, in the event of disputes or pre-dispute procedures or to respond to requests from authorised authorities):

Below are the different retention periods for Data collected by Vacances Bleues:

  • Data relating to prospects (persons who have never entered into a contract with Vacances Bleues) are held for three years after the last contact between the person concerned and VB. The following are considered as a "contact": a request for a quotation or brochure, opening the e-mail containing the newsletter or clicking on a hyperlink in a Vacances Bleues e-mail pointing to our holidays. At the end of this three-year period, an explicit request for consent will be sent to you in the form of a data protection consent campaign.
  • Data relating to customers who have signed at least one contract with Vacances Bleues are held for a period of ten (10) years after the service has been provided (see Article L213-1 of the French Consumer Code);
  • banking Data are not held after you have paid for your holiday and/or the services ordered, except where you have given your consent for them to be recorded or in the case of recurring payments, in which case they are held for the duration of our contractual relationship;
  • Data collected automatically through cookies, including browsing data, is held for a maximum of thirteen (13) months;
  • Data relating to your participation in solidarity projects with the Vacances Bleues Corporate Foundation are held for a period of three (3) years;
  • Data relating to a payment incident that has led to your registration in the Vacances Bleues overdue payment management system are held until the payment incident is resolved or, in the absence of such resolution, for a period of five (5) years;
  • information enabling us to take into account a person's right to object against their personal data being used for commercial canvassing purposes is held for a maximum of three (3) years from the exercise of this right.
  • Data relating to the monitoring and recording of your calls (subject to your prior consent) and Data relating to the processing of your complaints are held for a period of one (1) year.

 

5. RECIPIENTS WITH ACCESS TO DATA  

During the data retention period, Vacances Bleues takes the appropriate technical and organisational measures, in accordance with the applicable legal provisions, to protect your personal data appropriately so as to prevent damage, deletion or access by unauthorised third parties.

Access to your personal data is strictly limited to the following:

  • Vacances Bleues employees: reservation department using the booking software; IT department; sales department; marketing department; travel department and possibly legal department; establishment teams and generally, any appropriate person from the Vacances Bleues group entities for certain specific categories of personal data.
  • our sub-contractors (e.g. reception and technical service providers, IT maintenance and hosting service providers, routing service providers, etc.). The relevant sub-contractors are bound by a non-disclosure agreement and may only use your data in accordance with our contractual provisions and applicable legislation.
  • our commercial partners involved in the performance of agreements, such as transport companies, insurance companies, banks, customs authorities, etc.

We may also disclose data in order to comply with legal or regulatory requests, court orders, summons or legal proceedings, if required to do so by law, and if Vacances Bleues transfers all or part of its assets to a third party.
Vacances Bleues will never sell or lease your personal data to third parties for their own business purposes.

 

6. SECURITY OF YOUR PERSONAL DATA

Vacances Bleues has introduced appropriate security measures, in particular technical and organisational measures that allow personal data to be stored securely in order to prevent loss, tampering or any unauthorised or illegal use.

All persons with access to your data are bound by a non-disclosure agreement and may be subject to disciplinary action and/or other penalties if they fail to comply with these duties.

 

7. RIGHTS APPLICABLES TO PERSONAL DATA

In accordance with current legislation, Internet users who have agreed to provide their personal data have the following rights:

  • - The right to be informed about the use of your personal information
  • The right to access any personal data we hold about you
  • The right to request the correction of inaccurate personal data we hold about you (you can also change this data via your account).
  • The right to ask us to delete your data, or to stop processing or collecting your personal data, in certain circumstances
  • The right to object to the use of your personal data for commercial canvassing purposes
  • The right to withdraw your consent at any time to any processing operation based on this legal basis

  • The right to issue instructions concerning the storage, deletion and communication of your personal data after your death.

If you wish to stop receiving commercial messages from Vacances Bleues, you can also click on the unsubscribe link shown in each of our messages.

Vacances Bleues undertakes to reply as soon as possible, and in any event within one (1) month of receiving your request.
If necessary, this period may be extended by two (2) months, depending on the complexity and number of requests. In this case, you will be informed of the extension and the reasons for the extension of the deadline.

If your request is submitted electronically, the reply will also be sent electronically where possible, unless you expressly request otherwise.

If we are unable to comply with your request, we will inform you of the reasons and you will be entitled to lodge a complaint with a supervisory authority and/or seek legal redress.

In particular, if after having contacted Vacances Bleues and despite the latter's efforts, the Data Subject still believes that their rights have not been respected, they may file a complaint with the French supervisory authority, i.e. the French Data Protection Agency (Commission Nationale Informatique et Libertés - "CNIL"): https://www.cnil.fr/fr/plaintes.

In any event, Vacances Bleues systematically enters into a data protection agreement with all sub-contractors who process personal data on behalf of Vacances Bleues. This agreement aims to ensure that appropriate technical and organisational measures are taken to guarantee the security and confidentiality of the personal data being processed.

 

10. POLICY AMENDMENTS

Vacances Bleues reserves the right to amend or update the Policy at any time. Any amendment or update shall have immediate effect as soon as it is published on the Site. You undertake to read this Policy each time you visit the Site. The version in force will be the one available on the date you visit the Site.
